These terms govern your use of Xelent API (the "Service"), operated by Xelent Traders LLC ("we", "us"). By creating an account or using the API you agree to them.
1. The Service
Xelent API provides programmatic access to third-party image and video generation models through an API, a web dashboard and a playground. Models, prices and features may change; current prices are listed on the pricing page.
2. Accounts and API keys
You must provide a valid email address and keep your password and API keys confidential. You are responsible for all usage made with your keys. Tell us immediately if you believe a key is compromised, and revoke it from your dashboard.
3. Credit and payment
The Service is prepaid. You buy credit in US dollars by card; credit is deducted for each successful generation at the listed price. Credit is not a deposit, bears no interest and cannot be transferred between accounts. Refunds are governed by our refund policy.
4. Acceptable use
You must follow our acceptable use policy. We may block requests, suspend accounts and withhold credit where we reasonably believe the policy has been broken.
5. Your content
You keep the rights you have in your prompts and reference media, and, as between you and us, in the outputs. You are responsible for ensuring your inputs and your use of outputs do not infringe anyone's rights or break the law. Outputs are stored temporarily for delivery and deleted after the retention period.
6. Availability
The Service depends on third-party model providers and is provided "as is" and "as available". We do not guarantee uninterrupted availability, specific output quality or that a model will remain offered.
7. Liability
To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential losses.
8. Indemnity
You will indemnify us against claims arising from your inputs, your use of outputs, or your breach of these terms or the acceptable use policy.
9. Termination
You may close your account at any time. We may suspend or close accounts that breach these terms, that are linked to payment disputes or fraud, or where required by law.
10. Changes and law
We may update these terms and will post the new version here. Continued use after an update means you accept it. These terms are governed by the laws of the State of New Mexico, USA.
